TERMS AND CONDITIONS
DEPOSITS
At Rare Commodity Design Co., our dedicated artists work diligently to bring your project ideas to life. To initiate the design process, we require a non-refundable deposit equal to half of the total cost of your artwork. This deposit secures your project slot and allows our artists to allocate their time and resources towards your specific design. However, please note that after 72 hours of no communication, your deposit will be forfeited towards the work that has been initiated, and we will assume that you have chosen another graphic design provider.
Kindly be aware that deposits expire after 30 calendar days from the date of payment.
REVISIONS
Once you have approved your artwork, any further revisions will be subject to an additional charge of $15.00 per revision. This fee also covers color changes to ensure your design meets your evolving preferences and requirements.
TOTAL CONTROL
Rare Commodity Design Co. takes pride in our ability to bring your artistic vision to life. To achieve the best possible outcome, we encourage you to have a clear understanding of how you want your artwork to be portrayed. In the event that you are undecided or prefer to entrust our creative expertise, we offer the option of providing "Total Control." By opting for Total Control, you allow our team to exercise their creative minds fully to enhance your artwork. Please note that a Total Control fee of $45.00, in addition to the initial deposit, will be applied.
.PSD FILES FOR LOGOS
We also provide the option to purchase the original .PSD files for your logo design at an additional cost of $75.00. These files provide you with full access to the layered design elements, allowing for future modifications or resizing as needed. Please inform your assigned artist if you would like to include the purchase of .PSD files for your logo.
DELAY IN ARTWORK
While our artists work diligently using electronic tools, unforeseen technical issues or unexpected events may lead to delays in the design process. In such cases, where delays occur, we will make every effort to resolve the issue promptly. If a delay arises beyond our control, a full refund of the deposit will be granted.
RECEIVING YOUR ARTWORK
We are pleased to inform you that you can now conveniently download your artwork directly from our website under the "Client Download" tab. Once you have made the final payment, you will receive access to a secure portal where you can access and download your artwork files. We provide your artwork in high-quality formats, such as .PNG, ensuring the best resolution for your design.
By engaging our services, you agree to adhere to these terms and conditions, which aim to provide clarity, protect the interests of all parties involved, and maintain a professional working relationship throughout the design process.
INTELLECTUAL PROPERTY RIGHTS
Upon receipt of full payment, Rare Commodity Design Co. transfers the ownership of the final artwork, including the logo, to the client. The client becomes the sole owner of the intellectual property rights associated with the logo design.
However, Rare Commodity Design Co. retains the right to showcase the artwork, including the logo, in their portfolio, website, social media platforms, and other promotional materials to demonstrate their creative abilities, unless otherwise agreed upon in writing. This may include displaying the logo as part of their design portfolio or featuring it in promotional materials or case studies.
Rare Commodity Design Co. ensures that the client's proprietary and sensitive information shared during the design process remains strictly confidential. The agency will not disclose such information to third parties without the client's express consent, except as required by law.
The client is granted a non-exclusive, non-transferable license to use the logo for their intended purpose. This license permits the client to use the logo for their business-related activities, such as marketing materials, advertising, and online promotion, within the scope of their business operations.
It is important to note that the client may not sublicense, resell, or alter the logo without obtaining prior written consent from Rare Commodity Design Co. Any unauthorized use or reproduction of the logo is strictly prohibited.
Rare Commodity Design Co. acknowledges and respects the intellectual property rights of others. In the event that the client provides specific elements or materials for inclusion in the design, the client guarantees that they hold the necessary rights, licenses, and permissions to use such elements. The client will indemnify and hold Rare Commodity Design Co. harmless against any claims or liabilities arising from the unauthorized use of copyrighted materials provided by the client.
By engaging our services, you agree to these intellectual property rights and confirm that you have read and understood our policies regarding ownership, usage, and showcasing of the artwork.
TERMINATION OR CANCELLATION POLICY

Refunds: Rare Commodity Design Co. does not offer refunds for cancellations due to client miscommunications or client life circumstances, unless in cases of death or serious medical illness. If the project has been significantly progressed, where the work or process is more than 50% complete, no refunds will be provided.

Termination: Either party may terminate the project or contract by providing written notice. In the event of termination, the client will be responsible for payment for the work completed up to the termination date, including any applicable fees or expenses.
DISPUTE RESOLUTION
In the event of a dispute arising from the project or services provided, both parties agree to make reasonable efforts to resolve the dispute in an amicable manner. If a resolution cannot be reached through direct negotiation, either party may initiate mediation or arbitration proceedings as determined by the artist's discretion. The jurisdiction and governing laws for dispute resolution shall be as agreed upon by both parties.
LATE FEES AND INTEREST
Late payment fees and interest charges may be applied in the following circumstances:

Late Payments: If the client fails to pay the invoice within 7 calendar days after the completion of the work and the client's approval, late payment fees may be imposed.

Late Fees: A late fee of $25 may be charged for payments received beyond the agreed-upon due date. This fee is intended to cover administrative costs and account for the inconvenience caused by late payments.

Interest Charges: If payment remains outstanding beyond the specified due date, interest may be charged on the overdue amount. The interest rate will be 15%, calculated on a monthly basis until the payment is received in full.
CONFIDENTIALITY
At Rare Commodity Design Co., we value the confidentiality of our clients' ideas and information. We understand that the concepts, strategies, and any proprietary or sensitive information shared during the design process are valuable and should remain confidential.
We assure you that any ideas, concepts, or information shared by the client will be treated as strictly confidential. Our artists are committed to maintaining the utmost confidentiality and will not disclose or share any client information, ideas, or project details with third parties, except as required by law or with the client's express consent.
Please note that while we take every precaution to ensure the confidentiality and security of client information, absolute confidentiality cannot be guaranteed over the internet or electronic communication. Clients are encouraged to share sensitive information through secure channels or alternative means if necessary.
